This End User License Agreement (the “Agreement”) is between you and Ganduja Interactive OÜ (“Ganduja”, “we”, “us” or “our”) and governs your use of Pillow Punk, including related updates and downloadable content (the “Game”). By downloading, installing or using the Game, you agree to this Agreement. If you do not agree, do not install or use the Game.
1. License
Subject to this Agreement and the terms of the storefront through which you obtained the Game, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to install and use the Game for your own non-commercial entertainment on supported devices.
2. Ownership
The Game is licensed, not sold. Ganduja and its licensors retain all rights, title and interest in the Game, including its software, artwork, characters, music, names, logos and other content. No ownership rights are transferred to you.
3. Restrictions
You may not, except where applicable law expressly permits it:
- copy, distribute, rent, lease, sell or sublicense the Game;
- reverse engineer, decompile, disassemble or attempt to derive the source code of the Game;
- modify the Game or create unauthorized derivative works;
- use cheats, automation, exploits or unauthorized tools that interfere with the Game or another service; or
- use the Game or its assets for commercial purposes without our prior written permission.
4. Updates and availability
We may provide patches, updates or changes to the Game. Features may evolve during development. Support may change where reasonably necessary, subject to applicable law and storefront obligations.
5. Third-party services and software
The Game may include third-party software and may be distributed through a third-party storefront. Their terms and notices may also apply. Storefront account services, payments, refunds, cloud services and platform features are controlled by the relevant provider.
6. Privacy
Our handling of personal data is described in the Ganduja Interactive Privacy Policy.
7. Disclaimer
To the maximum extent permitted by applicable law, the Game is provided “as is” and “as available”. We do not guarantee that the Game will always be uninterrupted, error-free or compatible with every configuration. Nothing in this Agreement excludes rights or warranties that cannot lawfully be excluded, including mandatory consumer rights.
8. Limitation of liability
To the maximum extent permitted by law, Ganduja and its licensors will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Game. Any limitation applies only to the extent permitted in your jurisdiction and does not limit liability that cannot legally be limited.
9. Termination
This Agreement ends automatically if you materially breach it. On termination, you must stop using and uninstall the Game. Provisions that by their nature should survive termination, including ownership, disclaimers and limitations of liability, will remain effective.
10. Governing law
This Agreement is governed by the laws of Estonia, without prejudice to mandatory consumer protections and jurisdiction rights that apply in your country of residence.
